About these terms

These terms apply to your use of our websites, which are run by XIONIA LTD, registered in England and Wales (company number 17490446), with its registered office at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom. You can contact us through our contact form.

If you don’t agree to these terms, please don’t use our websites. Separate terms will apply if you buy products or services from us; nothing is on sale yet.

Products in development

The seven Xionia stars, StarShaper and the other products and services described on our websites are in development. When we say a product is coming soon, we mean it is in active development and we intend to release it; it isn’t a release date. We describe our products as they are designed to work, but what we show and describe, including product names, features, demonstrations, artwork and screenshots, may change before release, or a product may not be released.

Nothing on our websites is an offer to sell, a pre-order or a promise to release a product or feature on a particular date. Release timing, platforms, prices, crossgrade terms and the features included will be confirmed before anything is offered for sale.

Joining First Light or registering developer interest is free. It doesn’t create a contract to buy anything and doesn’t reserve a product for you.

First Light offers

First Light members will get an introductory offer on each instrument at its release, with the details announced alongside its pricing.

When an instrument’s pricing is announced, we’ll say what its First Light offer is and how long it lasts, and every First Light member will be able to take it up on the same terms. Until then, the details may change. Taking up an offer is up to you: being a First Light member doesn’t oblige you to buy anything.

Sound demonstrations and illustrations

The music at the top of our main StarShaper page is a recording made with prototypes of the stars’ engines. It isn’t a recording of StarShaper or of a finished Xionia instrument, and the finished instruments may sound different.

The other sound demonstrations on our StarShaper pages, such as the adaptive score for developers, are generated live in your browser to show how StarShaper’s instruments behave. Unless a demonstration says otherwise, they are not recordings of StarShaper or of any other Xionia instrument, and the instrument designs, visualisations and controls shown alongside them are illustrations.

The demonstrations of Motion Waves, Stellar Awakening and instruments within instruments on our StarShaper pages make no sound. Like those visualisations, they illustrate how StarShaper’s instruments are designed to behave, with example instruments.

Sound only plays when you press play. Please keep your volume at a comfortable level, especially with headphones.

Using our websites

You may use our websites for lawful purposes. Please don’t:

• try to gain unauthorised access to our websites, the servers they run on or any connected systems;
• attack or overload them, or introduce viruses or other harmful material;
• crawl them in a way that overloads them or ignores our robots.txt files;
• use them in a way that breaks the law or infringes anyone’s rights.

We may change, suspend or withdraw any part of our websites at any time. We don’t guarantee that they will always be available or free of errors.

Our content and trade marks

Our websites and their content, including text, design, artwork, code and the sound demonstrations, belong to Xionia Ltd or are used with permission, and are protected by copyright and other intellectual property laws.

We welcome search engines and AI systems. Anyone may crawl and index our websites and use their text and images to train, test and improve artificial intelligence models, including generative AI, and to quote, summarise and link to our pages in search results and AI answers. We make no reservation against text and data mining of our text and images, including under Article 4 of the EU Directive on Copyright in the Digital Single Market, and our robots.txt files let every crawler in.

This permission doesn’t extend to the recordings on our websites or to material we use under licence from others, such as our typefaces, and it doesn’t let anyone use our trade marks or logos as their own. For other uses, such as republishing our content, please ask us first through our contact form. You’re always welcome to share links to our pages.

XIONIA and STARSHAPER are trade marks of Xionia Ltd, and the Xionia and StarShaper logos are our brand assets. See Trade marks for details and how to use them.

Our websites use the Urbanist and Archivo typefaces under the SIL Open Font License 1.1.

Links to other websites

Where our websites link to other websites, we provide the links for information only. We don’t control those sites and aren’t responsible for their content or how they handle your data.

Our responsibility to you

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that the law doesn’t allow us to limit or exclude.

If you’re a consumer: our websites are provided for domestic and private use. We aren’t responsible for any loss of profit, loss of business or business interruption. We are responsible for foreseeable loss or damage that you suffer as a result of our breaking these terms or failing to use reasonable care and skill, but not for loss or damage that isn’t foreseeable. If we supply digital content that damages a device or digital content belonging to you because we didn’t use reasonable care and skill, we’ll either repair the damage or pay you compensation.

If you’re a business: to the extent the law allows, we exclude all implied conditions, warranties and representations about our websites, and we won’t be liable for any loss of profits, sales, business, revenue, data, goodwill or any indirect or consequential loss.

We take reasonable steps to keep our websites free of viruses, but please use your own protection.

Our privacy notice explains how we use personal data, and our cookie notice explains what our websites store on your device.

Changes to these terms

We may update these terms from time to time, for example when we start offering products for sale. The date at the top shows when they last changed. Please check them when you use our websites.

Which law applies

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you’re a consumer living in Scotland or Northern Ireland, you can also bring proceedings in your local courts, and if you live elsewhere you keep any protection given to you by the law of the country where you live.
